Insurance Bad Faith
$40.5 Million Jury Verdict

This was a verdict against an insurance company for punitive damages after they refused to settle an uninsured motorist case with their own insured.  In a clear liability uninsured motorist case, Allstate insurance refused to make a settlement offer to our clients.  The case was arbitrated and we were awarded the full uninsured motorist policy limits.  We then sued Allstate for their refusal to settle the case and for forcing our clients into expensive and time consuming litigation.  The jury awarded our clients $40,525,000.00.  At the time this was a record verdict for the highest punitive damage award in the United States.


Auto Accident
$4.1 Million Settlement

Our client was a passenger in a car that was driven into a utility pole.  Our client was paralyzed from the waist down.  The driver of the car did not have insurance, but we learned that he was a New York Times delivery person.  As it turned out he was required to return his undelivered newspapers and was on his way to drop them off when the accident occurred.  This settlement was with the New York Times for the negligent driving of their delivery person.  The New York Times claimed that he was an independent contractor.  The car driver joined the army after the accident and moved to Guam.  We flew to Guam, took his deposition and the case settled for 4.1 million dollars.


Burn Injury
$4.2 Million

Our client was at her apartment when a fire started.  There were no smoke detectors or an escape route.  Our client was severely burned and was without oxygen for about 5 minutes.  As a result of that she suffered brain damage in addition to her burn injuries.  We sued the owners insurance company and got a verdict of 3.8 million dollars.  Because we exceeded our earlier settlement offer, we were awarded an additional amount of $400,000 for a total of $4.2 million dollars.


Gas Explosion / Burn Injuries
$1.2 Million Judgment

Our client was cleaning a friend's garage.  He was using a solvent to clean oil off the floor of the garage.  The fumes of the solvent exploded when they came in contact with the pilot light of the water heater.  As it turned out the water heater sat directly on the floor of the garage instead of on a platform 18 inches above the ground as required by law.  This led to liability of the homeowner and a judgment of 1.2 million dollars.

This case started out as a simple low impact rear end accident.  After our client failed to respond to medical treatment we located and sent her to a medical specialist who diagnosed Reflex Sympathy Dystrophy (RSD) a very serious and painful disease.  Instead of treating our clients' injuries as a simple whiplash case we convinced Allstate to pay $1,000.000.


Dog Bite
$200,000 Settlement

Our client was a lady using the public sidewalk on a busy city street.  As she passed by an auto repair shop, a guard dog put his head through a hole in the fence and viciously bit a small chunk of flesh from her arm.  The owner of the repair shop was found negligent and his insurance company settled the case for $200,000.00.
